You agree to use the Website lawfully and not engage in any activity that may harm the Website, other users, or Spyx Art.
You must not attempt to gain unauthorized access to any part of the Website.
Our Website and its content are intended for individuals aged 16 and older.

3. Commission Terms

By requesting a commission from Spyx Art, you agree to the following:

Payments

A 30% deposit must be paid upfront before any commission work begins.

Revisions

Commissions include unlimited revisions, provided the requests are reasonable and within the original scope. If we determine that revision requests are being abused to add new work or significantly alter the original scope, we reserve the right to limit or refuse further revisions, and in severe cases, we may terminate the commission entirely.

Termination by Client

If you choose to cancel your commission, the upfront payment (30%) is normally non-refundable. However, if you provide valid reasons for cancellation, and the commission has not reached a late stage (e.g., final rendering), Spyx Art may, at its discretion, refund the deposit in full or in part.

Termination by Spyx Art

We reserve the right to terminate a commission at any time if we believe there is bad intent, abusive behavior, or violation of these Terms. In such cases, a partial or full refund may be issued at our discretion, depending on the progress made.

Ownership and Usage Rights

Spyx Art retains all copyrights and intellectual property rights to commissioned artworks unless otherwise agreed.
The client receives personal-use rights only. Commercial use requires explicit written agreement and may involve additional fees.
Spyx Art reserves the right to display completed commissions in portfolios, social media, or promotional material unless the client specifically requests confidentiality.

Right to Refuse Commissions

Spyx Art reserves the right to decline any commission request at our sole discretion, without the need to provide a detailed explanation. This may include, but is not limited to, commissions that we deem inappropriate, outside our artistic style, or otherwise not fitting.

Content Restrictions

Spyx Art will not create, under any circumstances, artwork that involves illegal, harmful, or morally objectionable content. This includes, but is not limited to:

Sexual or suggestive depictions of minors (cub art, underage characters)
Hate speech, discriminatory, or extremist material
Excessive gore, snuff, or other extreme fetish content

In addition to these restrictions, Spyx Art reserves the right to decline any subject matter at our sole discretion if we determine it to be outside our moral scope, personal boundaries, or artistic style.

4. Refund Policy

The 30% deposit is normally non-refundable.
Exceptions: If you cancel due to valid reasons and the commission has not yet reached a late stage, Spyx Art may, at its discretion, issue a full or partial refund of the deposit.
If you cancel after significant progress has been made (e.g., advanced coloring, final rendering), the deposit will not be refunded.
If Spyx Art cancels a commission, a partial or full refund may be provided depending on the progress made.
Refunds are not provided for completed commissions or delivered artwork.

5. Intellectual Property

All content on the Website (text, images, branding, and designs) is the intellectual property of Spyx Art unless otherwise stated.
You may not copy, redistribute, or reproduce any content without prior written consent.

6. Marketing & Communications

By providing your email address, you may receive updates, promotions, and marketing communications from Spyx Art, only if you have opted in.

7. Limitation of Liability

Spyx Art provides the Website and Services "as is" and makes no guarantees regarding uninterrupted or error-free operation.
We are not responsible for any indirect, incidental, or consequential damages arising from the use of our Website or Services.
Our total liability to you for any claim relating to the Service shall not exceed the amount paid by you for the specific commission.

8. Governing Law

These Terms are governed by and construed in accordance with the laws of the Netherlands and applicable EU law. Any disputes shall be subject to the exclusive jurisdiction of the courts in the Netherlands.
